These terms apply when you use MotorFacts, whether or not you pay for anything. By running a check you accept them.
They are written to be read. Where the law gives you a right we cannot exclude, this page says so rather than pretending otherwise.

MotorFacts is operated by Data Reach Ltd, a company registered in England and Wales under company number 16291834, with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ.

What the service is
We report what official and industry records held about a vehicle at the moment you ran the check, and we explain what those records appear to mean. That is the whole of it.
A report is not an inspection and does not replace one. It cannot tell you the current mechanical condition of a vehicle, whether a repair was carried out properly, or whether an advisory noted at a past test was ever put right. If you are buying, look at the vehicle, and consider having somebody qualified look at it too.
What we can and cannot promise about the data
We will provide the service with reasonable care and skill, which is your right under the Consumer Rights Act 2015 and is not something we try to contract out of.
What we cannot promise is that a record exists for something that happened. Every register reports what has been reported to it. A finance agreement a lender has not yet filed, a theft nobody has reported, or damage an insurer never recorded cannot appear in any check, ours or anyone else's.
This is why our reports say a marker was not found rather than saying a vehicle is clear. Those are different statements and we are careful to make the one we can stand behind.
- Where a register cannot be reached, the report says so and you are not charged for that part.
- Where a check covers only some registers, the report lists the ones it did not cover.
- Where our analysis reaches a conclusion, the report shows the reasoning so you can judge it yourself.
Paying for a report
Prices are shown before you pay, include VAT where it applies, and are the total payable. There are no additional charges added later.
Payment is taken by Stripe or PayPal, depending on which you choose. We never see or hold your card details.
A report is digital content supplied immediately. Before paying, you are asked to confirm that you want it produced straight away and that you understand this means losing the 14-day right to cancel. That confirmation, and the exact wording you agreed to, is recorded and sent back to you with your receipt. Using the site fairly
The free checks are genuinely free and we would rather not put them behind an account. That only stays possible if the service is not abused, so a few things are not allowed:
- Automated or bulk access, scraping, or any attempt to extract the data set rather than check individual vehicles. Our supplier quotas are finite and shared with paying customers.
- Reselling, redistributing or republishing our reports or analysis as your own.
- Using the service to harass, trace or build a profile of an individual. We do not publish keeper identities and the service must not be used as though we did.
- Circumventing rate limits, the paywall, or any technical measure.
Our analysis is ours
The underlying records come from the DVLA, the DVSA and the industry registers, and we use the government data under the Open Government Licence. The analysis on top of it, the wording, the design and the software are ours.
You may keep, print and share a report you have paid for, including sending it to a mechanic, a seller or an insurer. You may not republish it as a product or feed it into a competing service.
Liability
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not permit us to limit. Any clause that appeared to do so would be unenforceable and we have not written one.
Subject to that, and because a report costs a few pounds and the decisions taken around it involve thousands, our liability for any claim connected with a report is limited to the amount you paid for that report. If you have bought a tier that includes a data guarantee, that guarantee sits on top of this and has its own separate terms.
We are not liable for a loss that arises because a record did not exist to be found, because a register was wrong, or because a decision was taken on a report without also inspecting the vehicle.
Accounts
You do not need an account to run a check or to buy a report. An account exists so you can save vehicles and receive MOT and tax reminders.
Keep your password to yourself and tell us if you think somebody else has it. You can delete your account at any time from your settings, and doing so removes your saved vehicles and reminders. Records of purchases are kept for as long as tax law requires; the [privacy page](/privacy) sets out exactly what that means.
Changes, and the law that applies
We may change these terms. The version in force when you ran a check or made a purchase is the version that applies to it, which is why this page carries a date.
These terms are governed by the law of England and Wales. As a consumer you can bring proceedings in the courts of the part of the United Kingdom where you live, and nothing here changes that.
If you are unhappy with something, tell us first at contact@motorfacts.co.uk. We do not subscribe to an alternative dispute resolution scheme and are not required to, but if we cannot resolve a complaint between us you remain free to use an ADR provider where one is available, or to take the matter to court.
